Acceptance of Terms
These Terms of Use (“Terms”) are an agreement between you and xTrack LLC (“xTrack,” “we,” “us,” or “our”). By accessing or using the xTrack application, website, or related services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use xTrack.
Eligibility
xTrack is not intended for children under 13. You may use xTrack only if you can enter into these Terms under applicable law. If you use xTrack on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Accounts
xTrack supports accounts created with email credentials and access through Sign in with Apple. You agree to provide accurate information and keep account information reasonably current.
You are responsible for:
- protecting your account credentials and access to your device;
- activity performed through your account;
- not sharing or transferring account access in a way that compromises the service; and
- promptly notifying xTrack if you believe your account has been accessed without authorization.
Use of xTrack
xTrack grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the service for lawful, noncommercial fitness and training purposes in accordance with these Terms.
You may not:
- use xTrack for an unlawful, fraudulent, or abusive purpose;
- access another person’s account or impersonate another person or entity;
- probe, bypass, disable, or interfere with authentication, security, rate limits, or other service protections;
- disrupt the service or introduce malware, harmful code, or destructive content;
- scrape, crawl, or use automated means to extract xTrack data or content without permission;
- abuse xTrack APIs, infrastructure, or technical resources;
- reverse engineer, decompile, or attempt to derive xTrack source code, except to the extent applicable law does not permit this restriction; or
- remove proprietary notices or use xTrack in a way that infringes the rights of xTrack or others.
You must comply with applicable law and the rules of any platform you use to access xTrack.
Training and Health Disclaimer
Training metrics, scores, classifications, recommendations, and insights are estimates generated from available workout information, user preferences, and product rules. They may be incomplete, inaccurate, delayed, or inappropriate for your individual circumstances. xTrack does not guarantee performance outcomes, readiness, recovery, or training results.
You remain responsible for deciding whether an exercise, workout, or recommendation is appropriate for you and for exercising within your abilities. Consider your health, experience, environment, equipment, and current condition before acting on any xTrack output.
Consult a qualified professional when you have medical concerns or before making decisions related to an injury, illness, health condition, or readiness to exercise. Stop exercising and seek appropriate help if you experience concerning symptoms.
Free Trials and Promotions
xTrack may make a free trial, introductory offer, or promotion available for an eligible subscription. Availability is not guaranteed. Eligibility, duration, price after the offer, and other terms are displayed before enrollment and may be subject to Apple’s rules. Unless canceled as described at enrollment, a trial or offer may convert to a paid, automatically renewing subscription.
User Content and Training Data
You retain ownership of workout information, notes, custom exercises, settings, and other content you submit to xTrack (“User Content”). You are responsible for ensuring that you have the right to submit that content and that it does not violate law or another person’s rights.
You grant xTrack a limited, non-exclusive license to host, store, process, reproduce, transmit, and display User Content only as reasonably necessary to provide, maintain, improve, troubleshoot, and protect xTrack. This license ends when the content is deleted from xTrack’s systems, subject to legally required retention.
Intellectual Property
xTrack and its licensors own the service, including its software, design, visual interfaces, branding, logos, product content, documentation, training-analysis technology, and other materials provided by xTrack. Except for the limited right to use the service under these Terms, no rights are transferred to you.
Feedback
If you voluntarily provide ideas, suggestions, or other feedback about xTrack, you allow us to use that feedback to evaluate, improve, and develop the service without restriction or an obligation to compensate you. This does not give xTrack ownership of your User Content.
Third-Party Services
xTrack relies on third-party services, including Apple for Sign in with Apple, App Store distribution, and payments; RevenueCat for subscription and entitlement management; and Amazon Web Services for authentication, infrastructure, storage, APIs, and operational logging.
Third-party services are controlled by their providers and may be subject to separate terms and privacy practices. xTrack is not responsible for third-party services outside its control.
Service Changes and Availability
We may add, modify, limit, suspend, or discontinue features as xTrack evolves. We do not guarantee that every feature will remain available or that the service will be uninterrupted, timely, secure, or error-free. When practical, we will take reasonable steps to avoid unnecessary disruption.
Termination
You may stop using xTrack at any time and may delete your account through Settings → Account → Delete Account. Subscription billing must be managed separately through Apple as described above.
xTrack may suspend or terminate access when reasonably necessary because of a material violation of these Terms, abuse or fraud, a security or operational risk, a legal requirement, or conduct that could harm xTrack, its users, or others. Provisions that by their nature should survive termination will continue to apply.
Disclaimers
To the fullest extent permitted by law, xTrack is provided “as is” and “as available,” without warranties of any kind, express or implied. xTrack disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may be excluded.
We do not warrant that xTrack’s data, metrics, recommendations, or other content will be complete, accurate, reliable, current, or suitable for your circumstances. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, xTrack LLC and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, use, profits, goodwill, or other intangible losses, arising from or related to:
- your access to or use of, or inability to access or use, xTrack;
- training decisions, injuries, health outcomes, or reliance on xTrack metrics or recommendations;
- inaccurate, incomplete, delayed, or lost data;
- service interruption, device failure, or connectivity problems; or
- the conduct or services of a third party.
These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
Apple Services
When you download xTrack, use Sign in with Apple, or purchase a subscription through the App Store, your use of Apple’s services is also subject to Apple’s separate terms and policies. Nothing in these Terms changes any rights or obligations you may have under those terms.
Review the current Apple Media Services Terms and Conditions.
Changes to These Terms
We may update these Terms as xTrack, its services, or applicable requirements change. We will revise the “Last updated” date and may provide additional notice through the app, website, or another appropriate channel when a change is material.
Your continued use of xTrack after updated Terms take effect means you accept the revised Terms. If you do not agree to an update, you must stop using xTrack.
